Florida courts recognize that treatment for a substance abuse problem is often a more effective option than incarceration. One option that may be available to offenders is entering into the drug court treatment program. If successfully completed, a first-time offender may have their case dismissed, and a multiple offender may be able to avoid a felony conviction.
Drug court may be available to people charged with drug possession, prescription drug crimes, doctor shopping, and other drug crimes. Each person's progress in the program is closely monitored during judicial reviews. The goal is to help the individual get clean. However, if an outpatient program is not successful, a more intensive drug treatment program may be suggested. The program typically lasts between 18 months and three years. If the individual is not complying, he or she may go to prison. Multiple offenders may be able to avoid a felony conviction by successfully completing drug court.
